for short, are terms that define the different types of supervision people may be placed on in certain circumstances.\u00a0 <strong>Parole<\/strong> or <strong>ES <\/strong>apply to individuals released early from their <strong><em>prison <\/em><\/strong>sentence.\u00a0An individual released from <strong>prison<\/strong> on <strong>Parole <\/strong>or <strong>ES<\/strong> can be <strong>revoked <\/strong>for violating the conditions of their supervision.<\/p><p><strong>Probation <\/strong>applies to persons with<strong><em> jail <\/em><\/strong>sentences.\u00a0 A person&#8217;s probation can be revoked in two different ways, depending on whether the judge renders a &#8220;<strong>withheld<\/strong>&#8221; sentence,&#8221; or an &#8220;<strong>imposed and stayed<\/strong>&#8221; sentence.<\/p><p>With a <strong><em>withheld <\/em>sentence<\/strong>, the judge does not actually impose a sentence and the convicted person is placed on probation.\u00a0 If that person is later revoked for violating the terms of his\/her probation, they must go back before the\u00a0same judge to receive their sentence (up to the maximum allowed by statute) for the first time.<\/p><p>With an <strong><em>imposed and stayed <\/em>sentence<\/strong>, the judge determines the amount of incarceration time to be served, but does not require the convicted person to begin serving the sentence.\u00a0 If the judge decides to <strong>impose and stay<\/strong> a sentence and place the convicted person on probation\u2014and the probation is later revoked\u2014that individual will go directly to serving the amount of incarceration time the judge originally imposed.<\/p><p>Individuals facing revocation have a <strong>right to a revocation hearing<\/strong>.\u00a0 Wisconsin revocation hearings are not held before a circuit court judge.\u00a0 They are instead held by state <strong>administrative law judges <\/strong>(called <strong>ALJs<\/strong> or <strong>hearing examiners<\/strong>) who are employed by the Division of Hearings and Appeals of the Wisconsin Department of Administration.\u00a0 They are informal and typically held most often at the county jail or wherever the accused is being held in custody. A good example of this is police reports. Police reports\u2014without testimony from the officer who wrote the reports\u2014are ordinarily considered unreliable hearsay on a material fact and will likely be considered insufficient evidence to prove the violation alleged.<\/p><p>Also, the exclusionary rule, which prevents the state from using evidence against the defendant that was illegally obtained, does not apply to revocation hearings.\u00a0 Therefore, evidence that might have been suppressed or eliminated at pretrial proceedings in an open criminal case is admissible at revocation hearings.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3b2934e0 elementor-widget elementor-widget-toggle\" data-id=\"3b2934e0\" data-element_type=\"widget\" data-widget_type=\"toggle.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-toggle\">\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-9921\" class=\"elementor-tab-title\" data-tab=\"1\" role=\"button\" aria-controls=\"elementor-tab-content-9921\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><i class=\"fas fa-caret-right\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><i class=\"elementor-toggle-icon-opened fas fa-caret-up\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">Parole and Extended Supervision (ES) - Special Considerations<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-9921\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"1\" role=\"region\" aria-labelledby=\"elementor-tab-title-9921\"><p class=\"text9pt\">In <strong>parole <\/strong>revocations, the ALJ determines how much &#8220;good time&#8221; credit the defendant should forfeit or lose, and how much of the remaining sentence the defendant is required to serve.\u00a0 Eligibility for reparole is again available to the defendant; however, there will be no mandatory release date and the defendant can end up serving the entire remainder of the sentence.<\/p><p class=\"text9pt\">Under law prior to 2009 Act 28, with <strong>extended supervision <\/strong>(<strong>ES<\/strong>) revocations, the ALJ determined whether the ES should be revoked, but the circuit court judge determined the incarceration time the defendant must serve on the remaining sentence before being eligible for release again on ES.\u00a0 This <strong>reincarceration <\/strong>period can be up to the maximum length of the sentence, with credit given for time already spent in confinement.\u00a0 The defendant must serve the entire period of reincarceration ordered by the judge.\u00a0Under Act 28 (effective October 1, 2009), if a person&#8217;s ES is revoked it is the ALJ, rather than the circuit court, that determines the re-incarceration time.<\/p><p class=\"text9pt\">Waivers of Hearings<\/p><p class=\"text9pt\">If a <strong>paroled <\/strong>defendant <strong>waives <\/strong>(gives up) the right to <strong>a revocation hearing<\/strong>, the Department of Corrections (DOC) determines the length of reincarceration.\u00a0 The same is true for an ES defendant.\u00a0 If an <strong>ES defendant waives <\/strong>a revocation hearing, then the DOC determines the period of reincarceration to impose.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-183b16d9 elementor-widget elementor-widget-toggle\" data-id=\"183b16d9\" data-element_type=\"widget\" data-widget_type=\"toggle.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-toggle\">\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-4061\" class=\"elementor-tab-title\" data-tab=\"1\" role=\"button\" aria-controls=\"elementor-tab-content-4061\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><i class=\"fas fa-caret-right\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><i class=\"elementor-toggle-icon-opened fas fa-caret-up\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">Appealing a Revocation Decision<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-4061\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"1\" role=\"region\" aria-labelledby=\"elementor-tab-title-4061\"><p>There are several stages to challenging a revocation decision:<\/p><ol><li><strong>administrative appeal <\/strong>to the Division of Hearings and Appeals (DOHA)<\/li><li><strong>petition for writ of certiorari<\/strong><\/li><li><strong>appeal<\/strong> to the Wisconsin Court of Appeals (COA)<\/li><\/ol><p><strong>ADMINISTRATIVE APPEAL<\/strong> <strong>TO THE DOHA<\/strong>.\u00a0 The ALJ (administrative law judge) must issue\u00a0a written decision within 10 days after the hearing is concluded.\u00a0 Both parties have 10 days to appeal the ALJ&#8217;s decision.\u00a0 This must be done by filing a written appeal with arguments and any supporting materials with the administrator of the Division of Hearings and Appeals (DOHA).<\/p><p><strong>PETITION FOR WRIT OF CERTIORARI<\/strong> <strong>IN CIRCUIT COURT<\/strong>.\u00a0 Once the administrative appeal process has concluded, revocation\u00a0decisions may be challenged through judicial review by <strong>petition <\/strong>for <strong>writ of certiorari <\/strong>in the circuit court in which the defendant was convicted.\u00a0 <strong>Certiorari <\/strong>is\u00a0limited to:<\/p><ul><li>whether the administrative agency acted within its jurisdiction;<\/li><li>whether it acted according to law;<\/li><li>whether its action was arbitrary, oppressive, or unreasonable and represented its will rather than its judgment;<\/li><li>or whether the evidence was such that the agency might reasonably make the order or determination in question.<\/li><\/ul><p>The evidence that a court reviewing a revocation decision by <strong>writ of certiorari <\/strong>will consider is limited to evidence presented at the revocation hearing.\u00a0 New evidence is generally not permitted, nor will the court overrule the revocation decision based on the credibility of the state&#8217;s witnesses or the defendant.<\/p><p><strong>APPEAL TO THE COURT OF APPEALS<\/strong>.\u00a0 The decision on a writ of certiorari can be appealed to the Wisconsin Court of Appeals.\u00a0 The Court of Appeals&#8217;
