It is not just a matter of resolving any warrants,\ndetainers, or other holds that may be in place.&nbsp; Nor is it just a matter\nof posting bail in any open criminal case.&nbsp; Posting bail will have no\neffect on the VOP (violation of probation) hold.<\/p>\n\n\n\n<p>In order to get released from jail before a final probation revocation\nhearing, the probation agent would need to agree to it, which is unlikely since\nthe probation agent is trying to revoke the person in the first place.&nbsp;<\/p>\n\n\n\n<p>Sometimes there is a need for a preliminary hearing in a probation\nrevocation case.&nbsp; If one is held, a DOC magistrate would decide whether\nrelease was possible before the final probation revocation hearing. <\/p>\n\n\n\n<p>This decision to release from jail a person waiting for a final\nprobation revocation hearing requires the magistrate to find all of the\nfollowing true:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>this person is NOT believed to be\ndangerous,&nbsp;<\/li><li>there is NO likelihood this person will\nflee,&nbsp;<\/li><li>this person is NOT likely to engage in\ncriminal behavior before the revocation hearing takes place,&nbsp;<\/li><li>this person is NOT likely to violate\nthe rules and conditions of supervision, and<\/li><li>the length of the term to be served\nupon revocation is NOT great.<\/li><\/ol>\n\n\n\n<p>The DOC magistrate is merely another DOC probation agent,\nsometimes even from the same office as the assigned probation agent.&nbsp;\nBecause of this, it is very unlikely the magistrate would go against the original\ndecision of the probation agent.<\/p>\n\n\n\n<p>Unfortunately, a person on probation hold waiting for their final\nprobation revocation hearing is not eligible for Huber or work release either.<\/p>\n\n\n\n<p>All of these things would have to happen in order for a\nperson on probation to be released from jail before the final probation revocation\nhearing takes place.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>It is highly unlikely for anyone to get released from jail before their final probation revocation hearing.&nbsp;
