{"id":2221,"date":"2019-12-10T21:58:33","date_gmt":"2019-12-10T21:58:33","guid":{"rendered":"https:\/\/sydnefrench.com\/WIProbationViolationRevocationATRHearings\/?p=2221"},"modified":"2025-05-15T10:06:02","modified_gmt":"2025-05-15T15:06:02","slug":"how-long-can-they-hold-someone-in-jail-for-a-probation-violation-in-wisconsin","status":"publish","type":"post","link":"https:\/\/sydnefrench.com\/WIProbationViolationRevocationATRHearings\/how-long-can-they-hold-someone-in-jail-for-a-probation-violation-in-wisconsin\/","title":{"rendered":"How long can they hold someone in jail for a probation violation in Wisconsin?"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"2221\" class=\"elementor elementor-2221\" data-elementor-post-type=\"post\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-58770c10 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"58770c10\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-5ba570d2\" data-id=\"5ba570d2\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2675e5ed elementor-widget elementor-widget-text-editor\" data-id=\"2675e5ed\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><\/p>\n<p>People often ask <strong>how long they can hold someone in jail for a probation violation in Wisconsin<\/strong>.\u00a0 These types of <strong>probation holds<\/strong> are commonly referred to as <strong>VOP holds<\/strong>, or <strong>PO holds<\/strong>.\u00a0 (The two terms are interchangeable.)\u00a0 Although Wisconsin has administrative rules that set time limits for how long they can hold someone in jail on a PO hold, these <strong>time limits<\/strong> are not firm and can be extended with very little effort by the probation agent, which means a person may end up sitting in jail for months on a VOP hold.<\/p>\n<p>The DOC Division of Community Corrections\u2019 Manual describes the rules and procedures regarding how long they can hold someone in jail for a probation violation in Wisconsin:<\/p>\n<ol>\n<li>Offenders suspected of violating rules of supervision, federal, state, county, and municipal laws and ordinances \u2026 may be detained in jail or in correctional facilities.\u00a0 A written Order to Detain will be completed and filed with the detaining facility.<\/li>\n<li>The DOC may authorize detention for up to 3 working days.<\/li>\n<li>Within 3 working days after detention, the agent <em>should<\/em> complete the following activities:\n<ul>\n<li>view police report<\/li>\n<li>interview offender, victim, and witnesses<\/li>\n<li>present a summary of facts and recommendations to the supervisor.<\/li>\n<\/ul>\n<\/li>\n<li>Completing a Detention Extension Request form can extend the time limits on the original detention order:<\/li>\n<\/ol>\n<p><\/p>\n<p><\/p>\n<p><\/p>\n<p><\/p>\n<figure class=\"wp-block-table\">\n<table>\n<tbody>\n<tr>\n<td><span style=\"text-decoration: underline;\">Extension of <\/span><\/td>\n<td><span style=\"text-decoration: underline;\">Granted by <\/span><\/td>\n<\/tr>\n<tr>\n<td>First 3 working days<\/td>\n<td>Supervisor<\/td>\n<\/tr>\n<tr>\n<td>Next 5 working days<\/td>\n<td>Regional Chief<\/td>\n<\/tr>\n<tr>\n<td><em>***Any additional time<\/em><\/td>\n<td>Division Administrator<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/figure>\n<p><\/p>\n<p><\/p>\n<p>***This last level of extension makes it possible for an agent to keep someone sitting in jail on a probation hold for a probation violation <em>indefinitely<\/em>.\u00a0 Further, the rules state that once the agent serves someone on a PO hold with the official revocation notices (i.e., Notice of Violation, Recommended Action, and Statement of Hearing Rights), these time limits no longer apply and it is no longer necessary for the agent to request extensions.<\/p>\n<p><\/p>\n<p><\/p>\n<p>In practice, the DOC usually makes its decision to revoke (or not revoke) within 10 days or so.\u00a0 Not always, though.\u00a0 Sometimes, weeks may go by for the person on probation hold with no contact from their probation agent, no paperwork or other information describing the specific probation rules they are accused of violating, and no new criminal charges filed against them.\u00a0 Family members may even find their calls to the probation agent go unanswered.<\/p>\n<p><\/p>\n<p><\/p>\n<p>This is a travesty because while agents are out investigating any alleged rules violations, the person on P.O. hold may lose more than their freedom;
