My Probation Agent Is Recommending Revocation. Is It Too Late to Get an ATR in Wisconsin?

Usually, no. An agent’s recommendation for revocation does not necessarily mean the opportunity for an Alternative to Revocation is gone.

If your probation or extended supervision agent is recommending revocation, it can feel like the decision has already been made. But a recommendation for revocation is not the same thing as a completed revocation.

Wisconsin DOC recognizes Alternatives to Revocation as a response to supervision violations, and whether an ATR remains appropriate depends on the circumstances of the case. DOC has also expressly acknowledged that even after someone fails an ATR, another ATR or intervention may still be considered when the circumstances support it.

The more important question is not simply:

“Have I already had too many chances?”

It is:

“Is there a reason to believe a different ATR could actually work?”

That is where the analysis begins.

A Revocation Recommendation Is Not Always the End of the Analysis

An agent’s recommendation matters. But it does not answer every question about what should happen next.

The real issue is whether there is a meaningful alternative to revocation that addresses the problems that kept producing violations.

Sometimes that means looking closely at what happened in the earlier treatment or ATR:

  • Was the underlying problem correctly identified?
  • Was the right treatment provided?
  • Was the level of care appropriate?
  • Did the client actually understand and benefit from the way treatment was delivered?
  • Were mental-health, substance-use, trauma, learning, or cognitive issues missed?
  • Was there enough structure, monitoring, housing support, transportation, or follow-through?

A new ATR is much easier to defend when it is not simply another chance at the same plan.  It needs to be meaningfully different.

Three failed programs may simply mean the same underlying problem was missed three times.

Hiring Sydne to assist with our son's legal difficulties involving a probation revocation hearing was the best decision we could have made. Sydne was incredibly helpful to both ourselves and our son, in helping us navigate a very difficult and confusing process. Her attention to our son's case and situation was superlative. Her tremendous expertise, knowledge and practical common sense were evident throughout the entire process, and ended with a just and fair ending for our son.

Sydne is the most responsive and results orientated attorney I've met. Most attorneys minimize your concerns. Sydne listens and provides an excellent defense with the best outcome. I most certainly recommend her without a doubt.

Sydne represented me. I contacted and spoke to multiple attorneys, but was swayed by my impression of her as someone who was actively interested in helping me. I could not have been happier with my decision.

Sydne was very informative and made me feel at ease from the moment we first met. I would definitely recommend her to anyone who may find themselves in a similar situation as I.

Sydne is direct and supportive. It is difficult to find an attorney that will be honest and straightforward. Passive is not what I want and she is not! She is direct, aggressive and does not stand down.

Sydne was always available to answer every question I had throughout the entire process, but most importantly she worked not just for me, but with me. I feel like this was the difference between just being a client, and being her client.
